Acceptable Usage Policy

  1. Recordal
    1. Global Online hereby provides/sells the Service to the User on the acceptable usage policy herein contained which the User is deemed to have familiarised himself/herself with and have irrevocably accepted.
  2. Interpretation
    1. In these acceptable usage policy:
      1. User means the party who has purchased the Service and/or the goods and/or any person using the Service and/or the goods in terms of the acceptable usage policy herein contained;
      2. Service means the Service described herein provided by Global Online to the User in terms of the acceptable usage policy herein contained;
      3. Goods means any supplied and/or purchased item;
      4. Global Online means A. Howard and Associates CC trading as Global Online.
  3. Acceptable Usage Policy
    1. Global Online provides its Service of Internet access and provision, subject to the following acceptable usage policy.
    2. Please read this policy carefully before using or continuing to use our Service, because as the User you are expected to comply with all acceptable usage policy specified in this policy.
    3. We reserve the right to update this policy, from time to time, without notice to the User. However, Global Online will make reasonable efforts to notify the User of any changes to this policy.
  4. Laws and Regulations
    1. All Users agree:
      1. to use Global Online services and infrastructure only for lawful purposes; and
      2. not to violate any of the laws and regulations of South Africa.
  5. Registration Obligations
    1. All Users agree:
      1. to complete the Global Online registration form in an honest manner; and
      2. to update this form when and if the need arises.
      3. that if the User submits incorrect information to us, or we have reasonable grounds to suspect that the User has provided Global Online with incorrect information, Global Online reserves the right to suspend or terminate services to the User.
  6. Privacy Policy Statement
    1. All registration data and other relevant information are subject to Global Online's Privacy Policy Statement.
  7. Members Account, Password and Security
    1. Each User is responsible for the maintenance of the confidentiality of their own password and account, as well as for all activities occurring under their account or password. Global Online must be notified immediately of any unauthorised use of the password or account of a User. The use of the password and account name entitles use of the Service by only one User at any one time.
  8. User's Liability
    1. Users are responsible for all content that they upload, post, email, transmit or otherwise make available by using Global Online services. Global Online is not liable for any content, errors or omissions, or for any loss or damage incurred as a result of any use of content posted, emailed, transmitted or otherwise made available via Global Online Service.
  9. User's Undertakings
    1. The User undertakes, in respect of himself/herself and any other party using its access to Global Online's services, not to:
      1. engage in any hacking activity;
      2. upload, post, email, transmit or make available any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, racist or otherwise objectionable content;
      3. upload, post, email, transmit or otherwise make available any material which infringes any patent, trademark, trade secret, copyright or other intellectual property right of any party;
      4. upload, post, email, transmit or otherwise make available any unauthorised advertising, promotional materials, "junk mail", "spam'," chain letters", "pyramid schemes" or any other form of solicitation;
      5. wittingly or repeatedly upload, post, email, transmit or otherwise make available any material containing software viruses or any computer code, files or programmes designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
      6. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other Users of the Service are able to type, or otherwise act in a manner that negatively affects other Users' ability to engage in real-time exchanges;
      7. interfere with, or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policy or regulations of networks connected to the Service,
      8. intentionally or unintentionally violate any applicable local, state, national or international law, and any regulations having the force of law;
      9. "stalk" or harass another; or
      10. collect or store personal data about other Users.
  10. Uncapped Acceptable Usage Policy
    1. Uncapped Acceptable Usage Policy is a set of rules that is put in place to ensure the integrity of the network and to offer fair and equal usage across the board. Uncapped acceptable usage policy is determined within a rolling 10 day usage window and excludes usage from midnight and 6am.
    2. Global Online reserves the right to undertake the necessary steps to prevent excessive usage by the following means:
      1. adjusting the throughput of the Service based off the current and historic usage of the Service;
      2. limiting or preventing Service through specific protocols and/or ports;
      3. continuous excessive usage of a Service may result in termination of the account;
      4. any attempt to bypass shaping policies may result in termination of the account.
  11. Indemnity
    1. By using Global Online's Service, the User indemnifies Global Online against all claims, liabilities and expenses (including legal and other fees and disbursements) sustained in respect of, access to and/or use of the services provided by Global Online, this website, any information, data or material produced, transmitted or downloaded by the User or co-Users, and any breach by the User or co-Users of the acceptable usage policy of this policy, or of any law, code or regulation.
  12. Termination of Service
    1. Global Online is entitled to immediately terminate its Service to a User, if it believes that the User is in breach of any term, condition or provision of this policy, or of any law, code or regulation.
    2. Global Online has the right, to block, move, or takedown any content made available by any User through its Service.
  13. Changes to Acceptable Usage Policy
    1. Global Online updates this Acceptable Usage Policy from time to time so please review it periodically. The User may view such changes at https://www.globalonline.co.za and unless otherwise notified.
